2. The petitioner seeks bail in connection with Bihar P.S. Case No. 805 of 2021 registered for the offence under Sections 420, 406, 467, 468, 471/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is that he along with other co-accused defalcated Rs. 2 Crore in the school.

4. Learned counsel for the petitioner submits that the petitioner was teacher in the school and during lock down he approached the informant who is the owner of the school for his dues and therefore this false case has been registered against them.

5. He further submits that the petitioner is in

Patna High Court CR. MISC. No.45901 of 2023(2) dt.04-08-2023 2/2 custody since 16.03.2023 and the petitioner has falsely been implicated in this case.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Nalanda at Biharsharif/concerned Court below in connection with Bihar P.S. Case No. 805 of 2021.
