JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 20/22/23/24 of the Indian Penal Code.

Five kilograms of ganja was allegedly recovered from the possession of this petitioner. The forensic examination report reveals that recovered narcotic was ganja. Submission is that the petitioner is in custody since 03.12.2016. He has got no criminal antecedent and petitioner is ready to cooperate with the trial. The investigation is already complete and there is no material to substantiate that

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Motihari at East Champaran/Successor Court, in connection with N.D.P.S. Case No. 79 of 2016, arising out of Raxaul P.S. Case No.282 of 2016. With condition that both the bailors shall be residents of territorial jurisdiction of the Courtbelow and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
