Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 30-07-2021 Heard Mr. Rakesh Kumar, learned counsel for the petitioners and Mr. Ajit Kumar, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Chapra (Town) P. S. Case No. 196 of 2018, instituted for the offences under Sections 147, 188, 353, 341 and 34 of the Indian Penal Code. It has been alleged in the F.I.R. that the

Patna High Court CR. MISC. No.3879 of 2021(2) dt.30-07-2021 2/3 petitioners who had come out of jail were part of the procession which indulged in creating mayhem in the town.

The learned counsel for the petitioners has submitted that they are nobody so far as their status is concerned and the procession was not meant for them. It has been submitted that the matter was reported after considerable delay and, therefore, it appears that only because the petitioners had gone to jail in some other case, their names have been taken in the present case also.

The petitioners are not responsible for such unruly procession and their implication in this case is only the handy work of the local police.

Apart from the case in which the petitioners had been to jail about which reference has been made in the F.I.R., there is no other case pending against them. Regard being had to the general and omnibus nature of accusation of the petitioners of being part of

No.3879 of 2021(2) dt.30-07-2021 3/3 an unruly crowd, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra (Town) P. S. Case No. 196 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.
