JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-08-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.
In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 341, 323, 504/34 and 379 of the I.P.C and sections 3 (iii) (x) of SC/ST Act.
Allegedly, the petitioners abused and assaulted the informant and his mother by using caste name and further snatched silver chain.
Submission is of false implication, no offence under SC/ST (P.O.A) Act is made out as the occurrence has not taken place in public view and moreover the case has been compromised
Patna High Court Cr.Misc. No.35169 of 2015 (2) dt.27-08-2015 2/2 and compromise petition has also been filed in the court below itself.
The learned Special P.P. fairly submits that in view of compromise lenient view can be taken.
In the facts and circumstances as stated above, the petitioners are directed to surrender in the court of C.J.M. Bhojpur in connection with Shahpur P.S. Case No. 167 of 2015 within one month from the date of receipt/ production of a copy of this order and then considering the genuineness of compromise arrived at between the parties the learned court below shall release the petitioners on bail on execution of bail bonds to the satisfaction of the court below.
