The petitioner seeks bail in Turkaulia P.S. Case No. 17 of 2017 registered under Sections 363, 366A and 34 of the Indian Penal Code.

As per the prosecution case, the son of the petitioner, namely, Vicku Kumar has kidnapped the minor daughter of the informant along with his friend, Pintu Kumar. When the informant approached the petitioner, the father of Vicku Kumar, he along with others threatened him.

It is submitted by learned counsel for the petitioner that there is no allegation of kidnapping against the petitioner rather against the son of the petitioner. The petitioner has played

The victim in her statement recorded under Section 164 of the Code of Criminal Procedure has also stated nothing against the petitioner. The allegation of giving threatening to the informant by the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 20.03.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Sadar, Motihari in connection with Turkaulia P.S. Case No. 17 of 2017.
