1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Learned counsel for the petitioner submits that petitioner Chhotelal Paswan @ Chhotak Paswan was granted bail by order dated 16.05.2023 in Cr. Misc. No. 26961 of 2023 along with Karmu Paswan @ Karyu Paswan.
3. Learned counsel for the petitioner submits that Karmu Paswan, in compliance of the order dated 16.05.2023 in Cr. Misc. No. 26961 of 2023, surrendered and furnished his bail bonds and Chhotelal Paswan @ Chhotak Paswan also surrendered but his bail bonds were not accepted for the reason that in the order dated 16.05.2023 in Cr. Misc. No. 26961 of 2023, his father's name was recorded as Ramekbal Paswan but
Patna High Court CR. MISC. No.49010 of 2023(2) dt.26-07-2023 2/2 in the FIR, the name of his father was recorded as Ekbal Paswan, thus the learned counsel submits that the order dated 16.05.2023 in Cr. Misc. No. 26961 of 2023 be modified to read the description of Chhotelal Paswan @ Chhotak Paswan as "Chhotelal Paswan @ Chhotak Paswan, Son of Ramekbal Paswan @ Ekbal Paswan, Resident of Village-Bihta, Police Station-Imadpur, District-Bhojpur" instead of "Chhotelal Paswan @ Chhotak Paswan Son of Ramekbal Paswan, Resident of Village-Bihta, PS-Imadpur, District- Bhojpur".
4. In view of the submissions made by the learned counsel for the petitioner, the order dated 16.05.2023 in Cr. Misc. No. 26961 of 2023 is modified to the extent indicated above.
5. In the event, if the petitioner surrenders on or before 11.08.2023, the learned trial court shall accept his bail bonds on the same terms and conditions.
