The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/452/380/323/324/307/427/504 of the Indian Penal Code.
It is alleged that the petitioner along with 13 FIR named accused persons and 10 unknown variously armed came to the house of the informant and assaulted the informant and her family members. It is further alleged that the accused persons snatched jewellaries from the informant and her family members.
It is submitted by learned counsel for the petitioner that there is no specific accusation of assault against the
Patna High Court Cr.Misc. No.36185 of 2015 (2) dt.09-09-2015 2/2 petitioner though the petitioner was armed with pistol. It is further submitted that four persons received injuries from the informant's side but only one person namely Rukhsana Khatoon received grievous injuries. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Supaul P.S. Case No.106 of 2014, pending before the learned Chief Judicial Magistrate, Supaul.
With the above observation, this application is, accordingly, disposed off.
