JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-b)a/26of the Arms Act.

Petitioner was arrested in connection with Rafiganj P.S. Case No. 22 of 2015 and, made confessional statement leading to recovery of one fire-arm along with one empty cartridge. The said fire-arm is said to have been used in committing the murder of the deceased of Rafiganj P.S. Case No. 22 of 2015.

Submission on behalf of petitioner is that the petitioner has already acquitted in Rafiganj P.S, Case No. 22 of 2015 and so far as the present case is concerned; the seized firearm has not been recovered from conscious possession of the

Patna High Court Cr.Misc. No.46703 of 2016 (2) dt.25-10-2016 2/2 petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rafiganj P.S. Case No. 23 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad. (Hemant Kumar Srivastava, J) A.K.V./- U T
