This is an application for bail in connection with Dumariya P.S. Case No. 69 of 2014 registered for the offences punishable under Sections 365 and 366A/34 of the Indian Penal Code.

Petitioner is not named in the FIR and later on his name transpires in the statement of victim under Section 164 Cr.P.C. Submission of learned counsel for the petitioner is that allegation of kidnapping of victim girl is against other co-accused person and there is no specific allegation against him in the statement of victim girl. Further submission is that similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court in Cr.Misc.No. 22012 of 2016, vide order dated 27.7.2016 and he is in custody for about four months. Heard learned APP also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.40622 of 2017 (2) dt.04-09-2017 2/2 circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Dumariya P.S. Case No. 69 of 2014, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
