The petitioner has been in custody since 04.04.2018 in connection with Sandesh P.S. Case No. 48/2018 registered for the offences punishable under Sections 25(1-b)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that there has been no recovery from the conscious possession of the petitioner and he is languishing in jail. It is further submitted that though recovery is alleged to have made from the dickey of the vehicle by which the petitioner was travelling and not from his person and apart from the present case, the petitioner is named in two other cases in which he has already been extended the

Patna High Court Cr.Misc. No.39800 of 2018 (5) dt.18-08-2018 2/2 privilege of bail.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- IX, Bhojpur, Ara, in connection with Sandesh P.S. Case No. 48/2018.
