IN THE HIGH COURT OF JUDICATURE AT PATNA

Civil Writ Jurisdiction Case No.12355 of 2015 ====================================================== Rakesh Kumar Singh @ Rakesh Singh .... .... Petitioner/s

Versus

Reena Singh .... .... Respondent/s ====================================================== Appearance :

For the Petitioner/s : Mr. Rajiv Prashant For the Respondent/s : Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-05-2016 Heard the learned counsel, Mr. Rajiv Prashant for the petitioner.

By the order dated 02.04.2015, the learned Principal Judge, Family Court, Hajipur in Divorce Case No.36 of 2012 directed the petitioner to pay Rs.5,000 per month as maintenance under Section 24 of the Hindu Marriage Act.

Perused the order passed by the Court below. The Court below considered the fact that the petitioner has been directed to pay Rs.750 as condition for the grant of anticipatory bail. It is admitted fact that petitioner is working in Delhi in a private company and according to him, he is getting Rs.30,000. In such view of the matter, this Court in exercise of supervisory jurisdiction under Article 227 of the Constitution of India, this Court cannot hold panchayati and negotiate to fix the amount of the maintenance.

Patna High Court CWJC No.12355 of 2015 (2) dt.04-05-2016 I, therefore, find no reason to interfere with the impugned order. Thus, this writ application is dismissed. (Mungeshwar Sahoo, J) Saurabh/- U T
