Petitioner seeks bail in a case registered under section 3 of the R.P. (U.P) Act.

Neither petitioner was caught on the spot nor anything was recovered from his conscious possession and having similar allegation co-accused Basant Sah has already been granted privilege of bail by a coordinate bench of this court.
