Petitioner seeks bail in a case registered under sections 302, 364, 201/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the first information report and the present case was lodged against three named and five unknown persons. Informant and petitioner are co- villagers. It appears from perusal of the impugned order that in course of investigation, informant as well as some other witnesses suspected the hand of the petitioner in the present crime on the ground that prior to alleged occurrence, he had given threat to kill the deceased. Moreover, FIR named accused Akhilesh Singh has already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 25.2.2016 passed in Cr. Misc. no. 427/2016.
Patna High Court Cr.Misc.
