The petitioner seeks pre-arrest bail in Athmalgola P.S.Case No.63 of 2019 registered for the offence under Section 30(a) of Bihar Prohibition Excise Act.

Accusation is of recovery of 4.70 litres country made liquor kept in container from the house of the petitioner. Submission of the learned counsel appearing for the petitioner is of denial.

Learned A.P.P. has vehemently opposed the prayer for bail.

In the facts and circumstances of the case as well as nature of the offence, I am not inclined to grant anticipatory bail to the petitioner.
