The petitioners seek bail in Daudpur P.S. Case No. 01 of 2017 registered under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
The petitioner no.1 is said to have pointed pistol upon the informant while petitioner no.2 assaulted the informant by means of lathi. They were also said to have assaulted the brother of the informant over land dispute. A country made pistol was snatched by the informant from the petitioner no.1 and was handed over to the police.
It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in this case due to
Patna High Court Cr.Misc. No.31056 of 2017 (2) dt.06-07-2017 2/2 land dispute. The informant and his son have not sustained any fire arm injury and other injuries sustained by them were found to be simple in nature. The country made pistol was not seized by the police from the petitioner no.1 rather it is said to have been snatched by the informant from the petitioner no.1 and was handed over to the police. The petitioners have been languishing in custody since 02.06.2017.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saran at Chapra in connection with Daudpur P.S. Case No. 01 of 2017.
