JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code, sections 25(1-B)a/26/35 of the Arms Act.

As per the prosecution case, one country made pistol and some cartridges were recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner as the house in question is the joint family house. Petitioner has claimed clean

Patna High Court CR. MISC. No.51078 of 2021(2) dt.30-11-2021 2/2 antecedent and he is in custody since 22.2.2021. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Ghosi Police Station Case No. 463 of 2020.
