JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being neightbour of the informant is apprehending arrest in a case registered for the offences punishable under Sections 448,452,341,323,354,354B,504 and 506 of the Indian Penal Code.

The prosecution case is that the petitioner being neighbour of the informant tried to outrage the modesty of the informant and on protest being made the petitioner assaulted the family members of the informant.

It is submitted by the learned counsel for the petitioner that even assuming the accusation no offence under sections 354 or 354B IPC is made out. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and

Patna High Court Cr.Misc. No.38264 of 2015 (2) dt.23-09-2015 2/2 only for a petty dispute the accusation has been levelled. It is further submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sheikhpura in connection with Sheikhpura Mahila P.S. Case No.15 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
