JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory in a case registered for the offences punishable under Sections 341, 323, 324, 447, 379 and 504/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that though there is allegation of assault against the petitioner, the injury caused allegedly by him, has found to be simple in nature. He has submitted that there is a property dispute between the parties and a counter case was instituted by the father of the petitioner in respect to the same occurrence. Learned counsel for the petitioner has submitted that there is no chance of the petitioner absconding during the course of investigation or

Patna High Court Cr.Misc. No.17326 of 2015 (3) dt.30-07-2015 2/2 trial. The petitioner has no criminal antecedent, as stated in paragraph 3 of the application.

In view of the submission as above, let the petitioner above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Birpur, District-Supaul in connection with Pratapganj P.S. Case No. 81 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
