JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-12-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This second application, for grant of anticipatory bail, arises out of Jadia Police Station Case No. 18 of 2016, disclosing offences under Sections 392 and 411 of the Indian Penal Code.
Earlier, the petitioner's application for grant of anticipatory bail was rejected by this Court by an order, dated 22.09.2016, passed in Criminal Misc. No. 40651 of 2016.
This second anticipatory bail application has been filed on the ground that the informant and the petitioner have entered into a compromise.
Such
Patna High Court Cr.Misc. No.53357 of 2016 (2) dt.14-12-2016 2/2 compromise does not have any sanctity in the eyes of law. This second anticipatory bail application cannot be entertained. It is accordingly dismissed.
It is further indicated that if the petitioner appears before the Court below within a period of two weeks from today and seeks regular bail, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by the present order.
