JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 30-11-2016 Heard the counsel for the petitioner and the State. The petitioner prays for bail in Bihta P.S. Case No. 455 of 2016 registered under sections 47/50(c)/51 of the Bihar Excise (Amendment) Act, 2016.

The S.I. of Police lodged the case that on a secret information, a place near the Sone river was raided from where 130 litres of country-made liquor was recovered. 12 persons assembled there started escaping. However, the petitioner was arrested.

It is stated that the petitioner was simply passing through the way when he was apprehended on suspicion. He is in custody since 03.07.2016 having no criminal antecedents of having committed the offence of the kind for which allegation is

Considering the period of incarceration and the statements made at Bar, the Court directs release of the petitioner above named on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Danapur, Patna in Bihta P.S. Case No. 455 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
