JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-09-2018 The petitioner seeks bail in connection with Forbesganj (Simraha) P.S. Case No. 188 of 2017 dated 21.03.2017 instituted for the offences under Section 304 B, 201 and 34 of the Indian Penal Code.
The petitioner is the husband of the deceased. His prayer for bail was earlier rejected by this Court on 12.01.2018. It appears that the trial has proceeded and three witnesses, up till now, have been examined. Learned counsel for the petitioner has submitted that the pace of the trial is tardy and no witness has been examined in the year 2018.
The report which has been called for reflects that all coercive processes have been adopted by the trial court to ensure the attendance of the witnesses. Considering the accusation against the
Patna High Court Cr.Misc. No.35730 of 2018(6) dt.07-09-2018 2/2 petitioner, this Court is not inclined to grant bail to the petitioner for the present.
However, the trial court is directed to conclude the trial, preferably within a period of six months from today.
