Petitioner seeks bail in Special Case No.2813 of 2019 arising out of Shahjahanpur P.S. Case No.16 of 2019 instituted for the offence under Section(s) 37(a)(b)(c) of Bihar Prohibition and Excise Act, 2016, and Section 25(1-b)a, 26, 35 of the Arms Act.
Counsel for the petitioner submits that Petitioner is in custody since 16.03.2019.
It is alleged in the written report that one country made pistol loaded with live cartridge and two other live cartridges were recovered from possession of the petitioner. Counsel for the petitioner further submits that coaccused, Bushan Choudhary, has already been granted regular
Patna High Court CR. MISC. No.41353 of 2019(2) dt.10-07-2019 2/2 bail by co-ordinate Bench of this Court by order dated 21.05.2019 passed in Cr. Misc. No.33435 of 2019. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No.2813 of 2019 arising out of Shahjahanpur P.S. Case No.16 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
Further, (i) the petitioner will remain present on each and every date of trial, (ii) His absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled, and (iii) the petitioner will not intimidate the witnesses in any way and will not hamper the trial.
