This application is for grant of regular bail in connection with Complaint Case NO.79(C) of 2016 for the offences punishable under Sections 323, 504, 498A/34 of the Indian Penal Code.

Allegation against the petitioner is of cruelty and demand of dowry and he is said to be husband of the complainant. Submission of the learned counsel for the petitioner is that before filing of the present case, he has lodged a case under Section 9 of the Hindu Marriage Act for restitution of the conjugal life. He is still ready to keep her.

Patna High Court Cr.Misc. No.38429 of 2017 (2) dt.19-08-2017 2/2 Heard learned A.P.P. and learned counsel for the informant. They have opposed the prayer for bail of the petitioner but they have no objection to the proposal of the petitioner. Having heard both sides and in such view of the matter, let the petitioner be released on provisional bail in connection with Complaint Case No.79(C) of 2016 to the satisfaction of SDJM, Munger that he will keep his wife with him with all dignities and the learned court below will watch conduct of both the parties for a period of six month by calling them once in a month and if he is satisfied with their conduct especially the petitioner, he will confirm the bail bond of the petitioner, otherwise he is free to pass any other order/orders as he deems fit and proper.

With the aforesaid observation, this application is disposed of.
