JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 452,341,323,352,353,379,504 and 506/34 of the Indian Penal Code.
The prosecution case is that the accused persons including the petitioners entered into the office of the Head Clerk of Nagar Parishad, Lakhisarai and started abusing. The accused persons also assaulted the informant and threw in the office of informant dead body of animal.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.38024 of 2015 (2) dt.22-09-2015 2/2 that after joining of Punam Kumari, the Executive Officer, she started terminating the regular employees and engaging persons on temporary basis when enquiry was held by the District Magistrate and warning was issued to the Executive Officer and consequently the Secretary of Urban Development Department, Government of Bihar was informed, hence the present case has been lodged as a retaliatory measure. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Lakhisarai P.S. Case No. 483 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
