JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail inChousa .S. Case No.230 of 2016 registered under Sections 147, 148, 149, 341, 323, 385, 386, 387, 379, 504 and 506 of the I.P.C. and Section 27 of the Arms Act.

The petitioner along with other fifteen accused persons are said to have demanded extortion of rupees one lac from the informant and resorted firing at the house of the informant over not coughing up the demand and also slapped the informant and snatched Rs.20,000/- from him.

It is submitted by the learned counsel for the petitioner that the allegation leveled against the petitioner is not specific rather omnibus. No one has sustained any fire arm injury. He has not demanded any extortion. As a matter of fact, nephew of the

No.39641 of 2017 (2) dt.19-08-2017 2/2 informant has filed complaint case against S.H.O. of Chousa Police Station and due to said grudge S.H.O. has lodged five cases against the petitioners and his family members within a short span of one week. Out of the aforesaid five cases petitioner has been granted bail in two cases by this Court vide orders dated 21.07.2017 and 06.07.2017 passed in Cr.misc. No.22780/17 and Cr.misc. No.29585/17 respectively. Though 16 other cases are pending against the petitioner, but are of long back, i.e., 10-15 years and he has been enlarged on bail in all the aforesaid cases. Petitioner is in custody since 26.4.2017.

In view of the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Udakishunganj, Madhepura, in Chousa P.S.Case No.230/16.
