JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 30(a)/34/35 of the Bihar Prohibition and Excise Act, 2016.

From the tempo, which was driven by the petitioner, country-made liquor was recovered. Submission is that petitioner has got no criminal antecedent. He is in custody since 10.04.2017 and he has no knowledge that which of the passengers had put the same or carrying the same on the said vehicle.

Considering the facts of the case, let petitioner, above named, be enlarged on bail on completion of three months

Patna High Court Cr.Misc. No.29496 of 2017 (2) dt.05-07-2017 2/2 of custody on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Rohtas at Sasaram/Successor Court, in connection with Sasaram (Tilauthu) P.S. Case No.449 of 2017, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
