The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
It is alleged that the petitioner being a rice miller issued six cheques worth Rs. 30,00,000/- on different dates in 2013 as a consideration amount of the paddy supplied to the petitioner by the Bihar State Food and Civil Supplies Company Limited, Madhubani unit but the said cheques got bounced.
It is submitted by the learned counsel for the petitioner that subsequently in 2014 the petitioner paid
Patna High Court Cr.Misc. No.36436 of 2015 (3) dt.14-09-2015 Rs.30,00,000/- to the Bihar State Food and Civil Supplies Corporation Limited.
Learned counsel for the Bihar State Food and Civil Supplies Corporation Limited admits that the payments have been received.
In view of the stand of the learned Lawyer of the Bihar State Food and Civil Supplies Corporation Limited, Madhubnai, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani (Town) P.S. Case No. 400 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
