In this case, the petitioners are apprehending their arrest in connection with Gangta P.S. Case No. 03 of 2017 registered for offences under sections 147, 149, 341, 323, 325, 307, 379, 504 of the Indian Penal Code and Section 27 of the Arms Act.
The specific allegation has been made against Aditya Kumar Singh @ Rishi of attacking on the forehead of the Informant with an intention to kill but, the Informant tried to save himself with his hand, the attack was so severe that it caused fracture in the hand.
Allegation against the petitioner no.2 is that he has
Patna High Court Cr.Misc. No.20935 of 2017 (3) dt.20-07-2017 attacked with pistol but, the bullet missed the Informant. In the present case, case diary was called for, after perusing of the case diary, it appears that there is a specific allegation against Aditya Kumar Singh @ Rishi, the petitioner no.1.
Looking to the entire facts and circumstances of the case, let the petitioner no.2, namely, D.C. @ D.C. Kumar, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Arbind Kumar Singh, learned Judicial Magistrate, 1st Class, Munger in connection with Gangta P.S. Case No. 03 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
There being direct allegation against the petitioner no.1, this Court is not inclined to grant privilege of anticipatory bail to him.
Accordingly, the prayer for anticipatory bail of the petitioner no.1, namely, Aditya Kumar Singh @ Rishi is rejected. (Shivaji Pandey, J) Rishi/- U T
