Petitioner, who is in custody, seeks bail in connection with Rohtas P.S. Case No. 16 of 2018 registered for the offences punishable under Sections 366(A), 376, 506 of the Indian Penal Code and Section 4/8 of POCSO Act.
Informant is the father of victim, who in his written complaint has stated that his daughter namely Mansha Kumar, aged about 17 years on 08.01.2018 was going to school and in mid way petitioner abducted her, enticed her and took her away with him. It is submitted by the petitioner that the girl has been recovered and has been medically examined and according to medical report, she is major aged between 19 to 20 years and no
Patna High Court Cr.Misc. No.32067 of 2018 (6) dt.31-08-2018 2/2 external or internal injury was found. No opinion regarding recent intercourse expressed by Medical Board. Her statement under 164 of the Cr.P.C. has been recorded by the Magistrate from which it appears that she had herself gone with the petitioner and thereafter accompanied him. The petitioner has no criminal antecedent and he is in custody since 23.01.2018.
Considering the aforesaid fact and circumstances of the case let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Rohtas at Sasaram, in connection with POCSO Case No. 03 of 2018, arising out of Rohtas P.S. Case No.16/2018.
