In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 408, 409, 420 and 120 (B)/34 of the I.P.C.
Allegedly, the petitioner being the then Mukhiya committed financial irregularities in purchasing the solar light and misappropriated the amount allocated under 4th Finance Commission/ 13th Finance Commission.
Submission is that in this case similarly situated other co-accused have been allowed bail by another Bench of this Court vide Cr. Misc. No. 51739 of 2014 by order dated 26.06.2015 and as such the petitioner also deserves sympathetic consideration as
Patna High Court Cr.Misc. No.35316 of 2015 (2) dt.27-08-2015 2/2 the certificate case is also pending.
The learned A.P.P. is not in a position to distinguish the case of the petitioner.
In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Bhojpur at Ara in Bihiya P.S. Case No. 236 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
