The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 353, 332, 333, 323, 504, 325, 307, 188, 109, 120B, 427 of the Indian Penal Code and 3 and 4 of the Prevention of Damage to Public Property Act.
The prosecution case is that the idol of Goddesses Sarswati was being taken for emersion by a processionist, when Muslims community objected for singing songs by the processionist, resulting into pelting of stones by both sides, leading to registration of case against 26 named and 150 unknown persons.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.35285 of 2015 (2) dt.20-08-2015 petitioner that accusation is omnibus and general against mob. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia (Banjariya) P.S. Case No. 66 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
