JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 147, 148,149, 341, 323, 307, 302, 504, 506 of the Indian Penal Code.

As per prosecution, the petitioner along with other accused persons are said to have assaulted the informant and his brother. Co-accused Krishna Prajapati assaulted the brother of the informant with lathi on his head which proved fatal. It is submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. The main assailant is co-accused Krishna Prajapati. There is a case and counter case between the parties. Co-accused Sanjay Prajapati has been enlarged on bail by a co-ordinate Bench of this Court

Patna High Court Cr.Misc. No.32594 of 2017 (2) dt.13-07-2017 2/2 vide order dated 26.04.2017 passed in Cr. Misc. No.17384 of 2017 and one of the co-accused Naresh Prajapati has been granted on anticipatory bail by a co-ordiante Bench of this Court vide order dated 01.07.2017 passed in Cr. Misc. No. 27163of 2017. Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Amba P.S.Case No. 9 of 2017.
