Petitioner is in custody in connection with Excise Case No. 170 of 2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent and he is in custody since 7.5.2019.

In the instant case total 315 liters of toddy was seized.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner and on mere suspicion petitioner has been made accused in the instant case.

No.39598 of 2019(2) dt.27-06-2019 2/2 Considering the fact that petitioner has no criminal antecedent and he is in custody since 7.5.2019, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise, Samastipur, in connection with Excise Case No. 170 of 2019.
