2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 354B, 379/34 and other ancillary sections of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons including these petitioners and some unknown persons entered into the courtyard of the informant and assaulted her and also molested her by pulling her clothes.

4. Allegation of assault is general and omnibus against

Patna High Court CR. MISC. No.41896 of 2023(2) dt.31-07-2023 2/2 the petitioners and no specific overt act has been alleged against them. Case and counter case in which both parties sustained injuries. Specific accusation of giving kick over the abdomen of the informant is against co-accused Ganesh Chaupal. Rest of allegations are ornamental. Petitioners claim clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Jhanjharpur Madhubani in Jhanjharpur Police Station Case No. 264 of 2021 (GR No.1929 of 2021), subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
