The petitioner, who is in custody, seeks bail in connection with Warisnagar P.S. Case No. 27 of 2018 registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of Arms Act.

It has been contended on behalf of the petitioner that he has no criminal antecedent and he has been falsely implicated in this case. Although he has been named in the FIR but he has been implicated due to personal dispute with informant. Nothing has come in FIR that deceased had made any statement before police or other persons naming the petitioners as one of his assailants in this case.

No.38667 of 2018(5) dt.27-08-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur, in connection with Warisnagar P.S. Case No. 27 of 2018.
