The petitioner is in judicial custody since 16.01.2021 in connection with Kateya P.S. Case No. 246 of 2020 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

The allegation, as per the First Information Report is that upon information, the police raided the place. However, upon seeing the police party, the accused persons fled. On search 15 litres of country-made liquor have been recovered in front of the house of accused Surendra Yadav. Considering the fact that there is no recovery from the person of the petitioner and he is in judicial custody since 16th of

Patna High Court CR. MISC. No.51353 of 2021(3) dt.31-03-2022 2/2 January, 2021, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of IInd Additional Sessions Judge cum Special Judge, Excise, Gopalganj in connection with Kateya P.S. Case No. 246 of 2020 with the following conditions :- (i) one of the bonds shall be executed by the family members of the petitioner, who shall submit an affidavit to this effect showing his bonafide;

(ii) the petitioner will visit the Kateya Police Station every fortnight for the next six months;

(iii) the petitioner shall cooperate in the trial and ensure his present on each and every date and failure to do so for two consecutive dates without logical reason will entail process for cancellation of his bail bonds by the Trial Court itself.

With the aforesaid observation, the bail application is allowed.
