02. 13.07.2017 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in a case registered for offences under Sections 272, 273, 290 and 294 of the Indian Penal Code and Sections 30(A) and 37 (C) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 64 litres of country-made liquor and 800 ML of Nepali liquor were recovered from the possession of 8-10 persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 20.05.2017.
Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.32505 of 2017 (2) dt.13-07-2017 the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bairgania P.S. Case No. 123 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
