Petitioner seeks regular bail in connection with Warisnagar P.S. Case No.60 of 2017 registered for the alleged offences under Sections 341, 323, 307 and 506/34 of the Indian Penal Code.
As per the prosecution case, the petitioner along with other accused persons are said to have surrounded the husband of the informant. Co-accused, namely, Dipu Kuwar, Ripu Kuwar and four unknown persons attacked on the husband of the informant by means of rod on way to Darbhanga. When Bhaisur of the informant rushed in his rescue they also assaulted him by means of rod.
It has been submitted by learned counsel for the
Patna High Court Cr.Misc. No.32510 of 2017 (02) dt.13-07-2017 2/2 petitioner that the petitioner does not happen to be assailant. There is no injury report of the husband of the informant while the injury sustained by Bhaisur of the informant is simple in nature. The present case is counter blast of the case lodged by the petitioner side vide C.A. Case No.877/2017. He has been languishing in jail custody since 17.03.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Warisnagar P.S. Case No.60 of 2017.
