The petitioner seeks bail in connection with Sonbarsa P.S. Case No. 235 of 2016, registered under Section 136 of the Electricity Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been surfaced in the confessional statement of co-accused Tarun Kumar and Randhir Rai, thereafter, the petitioner has been remanded in the present case on 03.01.2017 from Dumra P.S. Case No. 323 of 2016. Further submission is that similarly situated co-accused Tarun Kumar
Patna High Court Cr.Misc. No.24709 of 2017 (3) dt.05-07-2017 2/2 and Randhir Rai have already been granted privilege of bail by this Court vide order dated 28.04.2017 passed in Criminal Misc. No. 17551 of 2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 235 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
