The petitioner seeks bail in anticipation of his arrest in connection with Parihar P.S. Case No.119 of 2021 instituted for the offences under Sections 8/20(B) (II) ©/21(c)/22(c)/23(c) of N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner is being sought to be arrested on the basis of the statement of co-accused made under Section 167 of the Act, which is not admissible in terms of judgment passed by the Supreme Court in Toofan Singh Vs. the State.

In view thereof, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down
