JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 26-07-2016 Special Case No.53 of 2008, which arose out of Kotwali P.S. Case No.272 of 2008, has been disposed of on 18.06.2016 by the Vigilance Special Judge-I, Patna.
2. In terms of the previous direction issued by this Court, petitioner was given the opportunity of inspecting the records and an affidavit has been filed after that inspection of records that name of the petitioner with full details with regard to his roll code, roll number, enlistment number and the marks do tally with the mark-sheet which the petitioner had been provided by the Bihar School Examination Board which is the successor in interest of Bihar Intermediate Education Council.

3. It will be in the interest of Bihar School Examination Board to reclaim the original records for the sake of posterity at the earliest by moving the vigilance special court and the Secretary of Bihar School Examination Board should take steps in this regard at the earliest.
4. So far as petitioner is concerned, the Registrar of Civil Court, Patna is directed to ensure that on an application being filed by the petitioner with the requisite fee etc., certified copy of the extract relating to the petitioner and the entry which has been talked about in paragraph-8 of the supplementary affidavit will be made over to the petitioner within a period of two weeks of such an application being filed.
5. The petitioner will produce the certified extracts of the entries before the Secretary of Bihar School Examination Board who will thereafter certify and issue the duplicate mark-sheet in favour of the petitioner.
6. Writ application stands disposed of now. The respondents must ensure compliance of the directives.
