JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-387, 364A/34 of the Indian Penal Code. The informant's husband was recovered and her statement u/S 164 of the Cr.P.C. was recorded. In the statement, the informant's husband specifically, stated that his brother namely, Ajay Kumar Pandey had taken Rs. 4,00,000/- (four lacs) from the petitioner No. 1 with assurance to get provide a job to his son but subsequently, his brother failed to get provide the job and also failed to return the above-said amount. The informant's husband further stated that he was made captive by the petitioners

Patna High Court Cr.Misc. No.44707 of 2016 (2) dt.18-10-2016 2/2 and asked his brother to return the money. However, due to timely arrival of the police, he could be saved. Petitioners do not have any criminal antecedent and are languishing in jail custody since 23-06-2016.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ishakchak P.S. Case No. 150 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
