Petitioner prays for bail in connection with Kudhani (Turki O.P.) P.S.Case No. 327 of 2016 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and allegation against him is that he assaulted and caused death of the deceased.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and in post mortem report no injury was found on the person of deceased. Heard learned APP and perused the viscera report, from which it appears that Carbofuran was detected in dark brown fluid and Carbofuran is a Carbamate Pesticide which is commercially
Patna High Court Cr.Misc. No.9697 of 2018 (6) dt.24-09-2018 2/2 known 'Furadan' and it is used as pest control and is highly poisonous.
Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
However, since the petitioner is in custody since 23.8.2017, learned trial court is directed to expedite the trial and conclude the same at the earliest.
