The petitioners apprehend their arrest in Vidyapati Nagar P.S. Case No.122 of 2018 registered under Sections 341, 323, 354, 379, 427, 447, 504, 506/34 of the Indian Penal Code. The informant alleged that on 25.10.2018, all the seven accused persons came near the house of the informant and began to abuse. The accused persons on the order of Doman Ray and his son, Sunil Kumar, entered into the house of the informant and assaulted the inmates of the house and took away

The learned counsel for the petitioners submits that occurrence is said to have taken place on 25.10.2018 but the F.I.R. was lodged on 30.10.2018. Prior to institution of the present case, Vidyapati Nagar P.S. Case No.119 of 2018 was registered on behalf of the petitioners on 29.10.2018. Some altercation took place between two sides in which both of them entered into scuffle. In order to save the skin, the informant lodged the case after five days of the occurrence. Taking into consideration the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-3, Dalsingsarai, District-Samastipur in connection with Vidyapati Nagar P.S. Case No.122 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
