Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-12-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 498(A), 504, 506/34 of the Indian Penal Code and Section 3, 4 of Dowry Prohibition Act.

It is a case of assaulting, outraging the modesty, abusing and ousting the informant from her matrimonial house by the petitioner and other co-accused persons. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that there is inordinate delay of 35 days in lodging the F.I.R. and in

It is further submitted that petitioner lives in Siliguri, West Bengal, since 2015 and he does not reside at his ancestral house at Bhagalpur.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Nathnagar P.S. Case No. 559 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
