The petitioner seeks bail in Alamnagar P.S. case No.70 of 2014 registered under Sections 302, 120B of the Indian Penal Code, pending in the court of Sub Divisional Judicial Magistrate, Madhepura.

The prosecution case, in short,is that on 5.5.2014 at about 1 P.M. the petitioner came near the informant's sister-inlaw (Bhabhi), namely, Chandni Devi, and fired shot on her, causing serious injury to her, while she was alone and during treatment she died in the Hospital.

Earlier the bail application of the petitioner was rejected by order dated 28.02.2017 vide Cr.Misc.No.6441 of 2017, taking into account that the petitioner is the assailant.

Patna High Court Cr.Misc. No.28915 of 2018(5) dt.26-09-2018 2/2 A report was called for from the court below regarding the stage of the case. It has been reported that the case has been committed to the court of Sessions.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of one year from the date of receipt/production of a copy of this order. The District Magistrate, Madhepura and the Superintendent of Police, Madhepura are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Madhepura and the Superintendent of Police, Madhepura.
