1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that during the course of investigation, informant along with Gaurav Kumar and Raunak Kumar were implicated as accused and were taken in custody but were granted the privilege of regular bail by the learned District Court. It is next submitted that the case of the petitioner is on a better footing.

3. Learned A.P.P. for the State submits that since the informant was implicated and subsequently was released on bail as submitted in that event the petitioner should also seek regular bail as in the FIR it is alleged that an amount of Rs.17,000/- was credited in his account from the PhonePe of the informant and

4. Learned counsel for the petitioner, at this stage, seeks permission to withdraw the anticipatory bail application with liberty to surrender and seek regular bail.

5. Permission is accorded.

6. Accordingly, the anticipatory bail application is dismissed as withdrawn.

7. It is made clear that if the petitioner surrenders and seeks regular bail, the learned District Court shall consider the case on its own merit without being prejudiced by the fact that petitioner before this Court withdrew and anticipatory bail application and keeping in mind that the informant along with Gaurav Kumar and Raunak Kumar have been granted the privilege of regular bail by the learned District Court.
