The petitioner seeks bail in Mufassil P.S. Case No.287 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.
The S.I., informant, after having received information raided the field of Bhushan Rai and recovered huge quantity of Indian made foreign liquor. The informant further alleged that on thorough inquiry, he came to know that all the accused persons, named in the F.I.R., are indulged in illicit trade of Indian made foreign liquor.
The learned counsel for the petitioner submits that nothing has been recovered from the physical or conscious possession of the petitioner. The liquor was recovered from the
Patna High Court CR. MISC. No.37665 of 2020(2) dt.09-02-2021 2/2 field of Bhushan Rai. Nobody has seen the petitioner keeping liquor in the field of Bhushan Rai. Petitioner is in jail since 15.07.2020. Petitioner has already remained in jail for about seven months.
Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Begusarai in connection with Mufassil P.S.
