The petitioner seeks bail in connection with Pali P.S. Case No. 09 of 2016, registered under Sections 399, 402, 353 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that on receiving secret information about gather of the miscreants for committing heinous crime, the informant along with other Police officials reached at Timalpur village, where petitioner along with Karu Paswan, Sudam Prasad Yadav and Shyamdeo Mochi were apprehended. On search, country made carbine recovered from the possession of the petitioner, country made carbine recovered from the possession of the Karu Paswan, whereas Sudam Prasad
Patna High Court Cr.Misc. No.24721 of 2017 (3) dt.05-07-2017 2/2 Yadav was found one country made pistol along with a live cartridge and Shyamdeo Mochi was found in possession of Rs. 10,000/- and extremists literature.
Learned counsel for the petitioner submits that similarly situated co-accused Karu Paswan and Shyamdeo Mochi have already been granted privilege of bail by this Court vide order dated 08.04.2017 and 13.07.2016 passed in Criminal Misc. No. 5267 of 2017 and Criminal Miscellaneous No. 27793 of 2016, respectively. Further submission is that petitioner is accused in three other cases, but he is on bail in all cases. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-III, Jehanabad in connection with Pali P.S. Case No. 09 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
