The petitioner apprehends his arrest in Warisaliganj P.S. case No. 100 of 2019 registered under Section 30(a) (c) (d) of the Bihar Prohibition & Excise Act.

The informant alleged that he got secret information that petitioner and others were indulged in manufacturing illicit liquor near western side of Durga brick kiln and on such he raided the place but the accused persons managed to flee away. From the place of occurrence different articles meant for manufacturing liquor and liquor were recovered. The learned counsel for the petitioner submits that petitioner has got no criminal antecedent. Save and except secret information received by the informant there is no material to show that petitioner was indulged in manufacturing of liquor.

Patna High Court CR. MISC. No.44204 of 2019(2) dt.18-07-2019 2/2 The informant has not disclosed the source of information. The petitioner is not accused in any case under Excise Act. Nothing has been recovered from the conscious possession of the petitioner.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Nawada in connection with Warisaliganj P.S. case No. 100 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
